Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the website kinzio.cc, and any mobile applications, software and services provided by Kinzio (“Kinzio”, “we”, “us”, “our”) (together, the “Services”). By using the Services you agree to these Terms. If you do not agree, do not use the Services.
Our Services
Kinzio develops and publishes mobile applications and provides related services, including app design, development, cloud/backend hosting, publishing and maintenance. Specific client engagements may be governed by a separate written agreement or statement of work, which takes precedence over these Terms where they conflict.
Eligibility & Accounts
You must be at least 13 years old (or the minimum age required in your country) to use our Services. Where an app requires an account, you are responsible for keeping your credentials secure and for all activity under your account. Please notify us immediately of any unauthorised use.
Acceptable Use
You agree not to:
- use the Services for any unlawful, harmful or fraudulent purpose;
- attempt to gain unauthorised access to, interfere with or disrupt the Services or their infrastructure;
- reverse engineer, decompile or copy the Services except where permitted by law;
- upload malware, spam, or content that infringes the rights of others;
- use automated means to scrape or overload the Services.
Purchases & Subscriptions
Some apps may offer in-app purchases or subscriptions processed by Apple App Store or Google Play. Billing, renewals, cancellations and refunds are handled by those platforms under their terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period through your store account settings.
Intellectual Property
The Services, including software, design, text, graphics and logos, are owned by Kinzio or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use our apps for personal, non-commercial purposes in accordance with these Terms and applicable app store rules. Ownership of deliverables in client projects is set out in the relevant client agreement.
User Content
If you submit content through the Services, you retain ownership of it but grant us a worldwide, royalty-free licence to host, store and display it solely to operate and improve the Services. You are responsible for ensuring you have the rights to any content you submit.
Third-Party Services
The Services may integrate or link to third-party services (such as Google Firebase, Apple, Google Play, payment or analytics providers). We are not responsible for third-party services, and your use of them is subject to their own terms and policies.
Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free or secure.
Limitation of Liability
To the maximum extent permitted by law, Kinzio will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $100.
Indemnification
You agree to indemnify and hold harmless Kinzio from any claims, damages and expenses (including reasonable legal fees) arising from your misuse of the Services or violation of these Terms.
Termination
We may suspend or terminate your access to the Services at any time if you violate these Terms or if required by law. You may stop using the Services at any time. Sections which by their nature should survive termination will survive.
Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page and revise the “Last updated” date. Continued use of the Services after changes take effect means you accept the revised Terms.
Governing Law
These Terms are governed by the laws of the jurisdiction in which Kinzio is established, without regard to conflict-of-law principles. Nothing in these Terms limits any rights you have under mandatory consumer protection laws.
